TERMS AND CONDITIONS (FOR AMATEUR PERFORMANCE)


The information below sets out our standard terms and conditions for amateur performance of one of our scripts. These terms and conditions apply following issuing of a licence to perform one of our scripts. 

INTRODUCTION
1. Our reading scripts include part of the text of the full script of the pantomime in question, and are provided free but are for review purposes only and do not convey any rights for performance.
2. Rights for performance are issued in the form of a licence and at the sole discretion of Pantomime Magic upon receipt of a fully completed licence application form together with payment in full of the appropriate fees for performance.
3. A licence for performance must be obtained prior to the start of rehearsals of our scripts.
4. None of our scripts may be reproduced in full or in part without the express written permission of Pantomime Magic.

LICENCE
1. Subject to the theatre company/society/organisation fully complying with these conditions, Pantomime Magic grants to the theatre company/society/organisation which has made a full application a non-exclusive licence to produce and give the authorised performances, as specified in the licence document.  
2. The theatre company/society/organisation shall pay to Pantomime Magic the appropriate fee, as specified in the licence document, in full before an editable rehearsal script will be issued and before the start of the rehearsal process. 
3. The theatre company/society/organisation is authorised to make minor changes to the work provided such changes do not damage the integrity of the work.  
4. Musical numbers suggested in Pantomime Magic’s scripts are for illustrative purposes only – inclusion of such suggestions in no way implies availability of rights to perform these numbers. Pantomime Magic does not own performance rights to any of the music suggested, unless otherwise stated. The theatre company/society/organisation accepts all responsibility for obtaining rights to any required music it chooses to include in the production separately from Pantomime Magic's licence from the appropriate authority.  
5. If the theatre company/society/organisation is in any doubt as to whether a change to the work is authorised under these conditions, it must seek Pantomime Magic’s advice, and, where appropriate, prior written consent.
6. If extra performances are arranged after a licence has been granted, it is essential that Pantomime Magic be informed immediately and the appropriate additional fee paid at least 4 weeks before the first performance, whereupon an amended licence will be issued.
7. Cancellation of the licence on the part of the theatre company/society/organisation prior to the start of the run of performances is subject to a 10% administration fee.

VIDEO RECORDING
1. Rights to video record rehearsals and/or performances are only granted if such rights have been paid for by the theatre company/society/organisation as part of the licence agreement in advance of any recording.
2. Pantomime Magic scripts are governed by copyright laws, and must not be video recorded (in any electronic format) without prior permission from Pantomime Magic and payment of the appropriate fee.
3. Pantomime Magic can only grant permission for the dialogue contained in the script to be video recorded. Such permission does not allow the theatre company/society/organisation to video record without the prior agreement of any paid performers, musicians, stage staff and the like. In particular, it does not convey any permission to video record copyrighted music. Permission for this must be sought separately from the appropriate authority.
4. Licence to video record only permits recording and subsequent copying for the private retention of members of the theatre company/society/organisation. It does not grant permission for public sales or screenings of such video recordings, including sharing on the internet, e.g. on sites such as ‘YouTube’ or similar. There is no exclusion to this, even for charitable purposes. 
5. Copies of the recording may not be sold commercially in any circumstances.
6. Should any infringement of these conditions come to the attention of Pantomime Magic, we reserve the right to take action where it is deemed necessary to protect our rights under the copyright act. 
7. The theatre company/society/organisation acknowledges that it would be an infringement of the intellectual property rights in the work to record or broadcast it (or any part of it). The Society shall use its best endeavours to ensure that there is no unauthorised recording or broadcast of the work by any person attending a rehearsal or performance of it.

COPYRIGHT ACKNOWLEDGEMENTS
1. The theatre company/society/organisation must include the following text in all promotional material in relation to this work: “A Pantomime Magic script.” The Pantomime Magic logo must also be included in all such promotional material.  This includes in all programmes, advertisements, leaflets, website, and other publicity material for the authorised performances.  
2. If requested by Pantomime Magic, the theatre company/society/organisation shall provide to Pantomime Magic a copy of the printed programme and any leaflet, poster or other publicity material produced in respect of the authorised performances, and shall provide to Pantomime Magic the details of any publicity that it publishes (or causes to be published) using the internet.  
3. All rights in the work not expressly licensed in accordance with these conditions are reserved to Pantomime Magic.

GENERAL
1. These conditions may only be amended or varied in writing signed on behalf of both Pantomime Magic and the theatre company/society/organisation. A waiver of any right under these conditions is only effective if it is in writing and it applies only to the party to whom the waiver is addressed and the circumstances for which it is given. 
2. The theatre company/society/organisation confirms that all information provided by the theatre company/society/organisation to Pantomime Magic in relation to its application to perform the work is true, complete and accurate, and the theatre company/society/organisation shall immediately inform Pantomime Magic if it becomes aware of any inaccuracies.
3. If the theatre company/society/organisation is in breach of any obligation to Pantomime Magic, Pantomime Magic may terminate any licence granted in accordance with these conditions. Termination of the licence, however arising, shall not affect or prejudice the accrued rights of the parties as at termination or the continuation of any provision expressly stated to survive, or implicitly surviving, termination. Pantomime Magic shall have no liability to the theatre company/society/organisation if it is prevented from, or delayed in, performing its obligations under these conditions or from carrying on its activities by acts, events, omissions or accidents beyond its reasonable control.
